User Accounts and Registration

Account Creation

Account Responsibility

Game Submissions

Submission Process

When you submit a game for publishing consideration:

  • You grant us the right to review, evaluate, and test your game materials
  • You represent that you own or have the necessary rights to the submitted materials
  • You understand that submission does not guarantee a publishing agreement
  • We will respond to suitable submissions within one week with honest feedback

Intellectual Property

Unless otherwise agreed in a separate publishing agreement:

  • You retain all intellectual property rights to your game
  • We do not claim ownership of submitted materials
  • You grant us a limited license to review and evaluate your submission

Publishing Agreements

If we offer to publish your game, the specific terms will be outlined in a separate publishing agreement, which may include:

  • IP ownership and licensing terms

No Recoup Model

Our publishing model is designed to allow developers to earn revenue from day one without traditional recoupment structures, as detailed in individual publishing agreements.

Intellectual Property Rights

Our Content

All content on our Services, including text, graphics, logos, images, and software, is the property of IZilla Games or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for their intended purpose. You may not:

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee of Results

We do not guarantee:

  • Specific sales, revenue, or performance results
  • Platform approval or distribution
  • Continuous, uninterrupted access to our Services

International Operations

While we operate internationally, we make no representation that our Services are appropriate or available for use in all jurisdictions. You are responsible for compliance with local laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Damages Limitation

IN NO EVENT SHALL IZILLA GAMES, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Arbitration

Any dispute arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. The arbitration shall take place in the United States.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration, except where such waiver is prohibited by law.

Exceptions

Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized access to our systems.

Termination

By You

You may stop using our Services at any time. If you have an account, you may request account deletion by contacting us.

By Us

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for:

Effect of Termination

These Terms, together with our Privacy Policy and any separate publishing agreements, constitute the entire agreement between you and IZilla Games regarding our Services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

International Users

By using our Services from outside the United States, you acknowledge that you are transferring information to the United States and consent to such transfer.
